We, UMW Pennzoil Distributors Sdn Bhd is a company under the Sime Darby Berhad group of companies and its related subsidiaries, associate companies and affiliates (whichever the context applies, to be referred to as "UMW", "UMW Division", "our", "us", "we") and we appreciate and respect your privacy. For the avoidance of doubt, UMW Division means any company or entity which is an ultimate holding company, holding company, related corporation, joint venture associate or a subsidiary of UMW or any entity within the Sime Darby Berhad group of companies.
By this Personal Data Protection Notice ("Notice"), we intend to explain how we process, collect and handle your personal data (as described in Section (1) below) in the light of the Personal Data Protection Act 2010 ("Act"). Please note that we may amend this Notice at any time and any such amendment will be notified via our website or by email or through any other suitable modes of communication. Any such amendment will be effective upon such notification.
By accepting and acknowledging this Notice, you consent to UMW processing and collecting your personal data (as described in Section (1) below) in the manner set out in this Notice.
(a) Personal data means any information which relates to you that is collected by or provided to UMW for the Purposes (as defined hereinbelow) stated in Section (2).
(b) Personal data includes but is not limited to your name, contact details, address, identification details (including identification card number, passport number, work permit number and related identification documents), financial and banking account details, tax information (for purposes of e-invoicing), CCTV or security recordings (including images, photographs and video recordings), location tracking or GPS information, photographs, nationality, age, gender, signature, ethnicity, physical or mental health condition, religion, political opinions, professional experience, professional qualifications, business information, records of past transactions with UMW, recordings of your voice from calls made to UMW, designation, biometric data, information relating to commissions or alleged commission of any offence, and any other personal data that you provide to us or that we collect from you on any subsequent occasions for the purpose of entering into a commercial transaction.

(b) Dealer, vendor, supplier or service provider: UMW collects your personal data directly from you or indirectly from third parties, public domain, your employer or searches carried out, or information obtained from any regulatory or credit reporting agency. For example:

(c) You may, by providing us with a notice in writing: (i) limit the processing of your personal data or request us to cease or not begin processing your personal data for purposes of direct marketing; and/or (ii) withdraw your consent previously given to us (in full or in part) to the processing of your personal data, subject to any applicable legal restrictions and a reasonable duration of time for such notice/request to be effected. Please be aware that if you limit the processing or withdraw your consent to any or all use of your personal data, it may result in: (i) us being unable to continue to administer any arrangement or contractual obligations relevant to any services between you and us; (ii) us being unable to perform any of our contractual obligations to you (if any); (iii) us being unable to process your personal data for any of the Purposes; and/or (iv) the termination of any arrangements/agreements/contracts between you and us, without any liability on our part ("Consequences").
All information requested from you by us is obligatory to be provided unless stated otherwise. Should you fail to provide the obligatory information ("Compulsory Personal Data") requested by us, it may result in any of the Consequences under Section 1.2(c), in which case UMW shall not be liable for any cancellation, termination, or the inability to perform any contractual obligations due to the failure of providing Compulsory Personal Data to us.
We may transfer your personal data to a place outside of Malaysia and you hereby give your consent to the transfer.

By acknowledging this Notice, you give your explicit consent to UMW to process your sensitive personal data such as your misconducts (if any) for the purposes described above or as required by law. UMW may also obtain your sensitive personal data from other parties to the extent it is permissible by law.
Your personal data provided to us may be disclosed or transferred to the following classes of third parties (within or outside of Malaysia) as required under the law or pursuant to relevant contractual relationships for the Purposes stated in Section (2):

We may require your assistance if the personal data relating to other persons is required to process your personal data for the Purposes and you hereby agree to use your best endeavours to assist us.
In the event that personal data of any third party is supplied by you to us, you shall ensure that such third party has read this Notice, thereby agreeing to be legally bound by the terms and conditions of this Notice and consented to us collecting and processing his/her personal data for any of the Purposes prior to the supply of his/her personal data to us.
Where another person is providing/submitting any of your personal data to us, you agree that you have authorised the disclosure of your personal data to us and consented to the processing of your personal data by us in accordance with this Notice.

These sites may have their own privacy statements and UMW does not control, recommend or endorse these sites and will not be held responsible for their contents. (a) Location enabled products or applications transmit your location information to us. UMW will not use the information sent or provided by you for any other purposes other than to provide the services or products you requested. Location enabled features are opt-in and you have control over your participation and can turn these services off at any time or uninstall them.
(b) Some mobile applications will utilise Google Analytics (or a similar tool) to help UMW serve you through improved products and services and revisions to the mobile applications. The information collected will not allow UMW to identify you. It may, however, let us know anonymously the services and products most searched by you within the application as well as device type used and your country of origin.

Any request for access or correction of personal data may be subject to: (a) a prescribed fee; (b) our discretion to comply with such request where we shall inform you of our refusal to do so and its reasons; (c) the prevailing data protection laws in Malaysia.
In the event of any conflict between the English version and the Bahasa Malaysia version of this Notice, the English version of this Notice shall prevail.
